Kesha Rose Sebert (born: March 1, 1987 (1987-03-01) [age 38]), better known professionally as simply Kesha, (also known as Ke$ha) is an American musician, singer, songwriter, and actress who performs the genres of pop, electropop, dancepop, synth-pop, rock, pop rock, rap, pop rap, and hip hop. She was introduced to music at a young age by her mother, Pebe, a songwriter. Her mother's most notable songwriting success was "Old Flames Can't Hold a Candle to You," which was a hit for Joe Sun and Dolly Parton.[1]

Career[]

Since she began her career in 2005, she's released a total of four studio albums, including Animal, (2010), Warrior, (2012), Rainbow, (2017), and High Road, (2020), one remix album, which is I Am the Dance Commander + I Command You to Dance: The Remix Album, (2011), and two extended plays, which included Cannibal, (2010), and Deconstructed, (2012). She's best known for her hit singles TikTok, Blah Blah Blah, Your Love is My Drug, Take It Off, and Praying.

Early life[]

At the age of 17, Kesha dropped out of high school to pursue a music career. She changed her name to Kesha and relocated to Los Angeles to work with producer Dr. Luke, who had previously worked on hit songs for Katy Perry and Kelly Clarkson, among others. "I thought her voice was unique, and I fell in love with her personality," Dr. Luke told Entertainment Weekly.[2] "She had the same sass and irreverence she has today." Kesha was determined to get into the business. According to one story, she paid a gardener to enter music legend Prince's home and leave one of her demos for him. She also got some work as a backup vocalist, singing on Britney Spears and Paris Hilton songs.

Commercial Breakthrough[]

Kesha soon signed a record deal with RCA following her collaboration with Flo Rida. She released her first single, "Tik Tok," later that year. The party anthem quickly gained a following, becoming one of the most downloaded songs in America and eventually reaching the top of the Billboard pop charts in January 2010. Kesha has faced criticism for some of her lyrics, particularly those about drinking and alcohol, due to her popularity among young people. "I'm not a babysitter," the singer explained. "It is the parents' responsibility to care for their children." Kesha draws inspiration for her songs from her own life. "I'll hang out with my friends and get rowdy... I am not sorry, and I will write about it."

Her debut album, Animal, peaked at number one on the charts after its release in January 2010. In addition to "Tik Tok," Kesha had two other top ten hits: "Blah Blah Blah" and "Your Love Is My Drug." This work was accompanied by the extended play release Cannibal. She built on her initial success with 2012's Warrior, which included the single "Die Young." A companion extended work, Deconstructed, was published in 2013.

Controversy[]

Dr. Luke's sexual assault[]

Kesha faced some personal issues in 2014. In January, she sought help for her eating condition. Later that year, Kesha filed a lawsuit against producer Dr. Luke, saying he drugged and then sexually assaulted her, among other things. Dr. Luke has sued Kesha and her mother for slander. During this difficult period, Kesha has received support from other singers such as Adele and Lady Gaga. Taylor Swift even gave $250,000 to the singer following a February 2016 court judgment that denied Kesha an injunction that would have released her from her contract with Dr. Luke's label at Sony Music. While the court refused Kesha's plea, it was clear that Sony Music has been working to resolve the matter behind the scenes. A lawyer from Sony Music told the New York Times, "Sony has made it possible for Kesha to record without any connection, engagement, or interaction with Luke whatsoever, but Sony is not in a position to terminate the contractual agreement between Luke and Kesha."[3]

Kesha and Dr. Luke reached a settlement on June 30, 2023, in a defamation case following a nearly ten-year legal struggle that started with Kesha's 2014 allegations against him. The settlement comes after the New York Court of Appeals recently ruled that Dr. Luke, a.k.a Lukasz Gottwald, is a public figure and that in order to prevail in his defamation lawsuit against Kesha, he must demonstrate "actual malice." The Reporters Committee for Freedom of the Press, spearheading a media alliance, had pushed the court to make that ruling, claiming that previous rulings that the music producer is a private individual were incorrect.[4]

The real perniciousness standard, established by the U.S. Supreme Court in Modern York Times v. Sullivan, requires public figures and public authorities to prove that a defamatory statement was made with knowledge of its lie or reckless disregard for the truth. Private figures must also prove that a defamatory explanation was made with carelessness. The ruling by the state's most significant court would have made it harder for Dr. Luke to win in the case if the case had gone to trial later this summer.

In 2020, a Unused York trial court ruled that Dr. Luke was not an open figure, as he never incorporated himself into the open discussion about sexual assault. After Kesha requested the decision, the Columnists Committee, along with 16 media organizations, filed three friend-of-the-court briefs against the pop star, emphasizing the impact of such a ruling on public-interest news coverage. In 2021, the re-appraising division of the Unused York Incomparable Court affirmed the lower court's ruling, prompting Kesha to request the Unused York Court of Offers, the state's most significant court. The Columnists Committee and 28 media organizations urged the court to reverse the lower court's ruling and find Dr. Luke an open figure.

The Modern York Court of Requests eventually agreed, concluding that Dr. Luke could be a limited-purpose open figure and must demonstrate genuine noxiousness. Judge Michael J. Garcia stated that Dr. Luke intentionally sought media attention for himself, his businesses, and the craftsmen he worked with, including Sebert, to advance their trade interests. After the court's ruling, Dr. Luke dropped the criticism claim against Kesha, and the case was set to go to trial in June 2023. Both Dr. Luke and Kesha reported the settlement on their social media accounts.
